LifeLabs Privacy Breach Class Action

Were you a LifeLabs customer on or before December 17, 2019, and were you living in Canada as of October 25, 2023? If so, you belong to a class of people who could get cash benefits from a class action settlement with LifeLabs. Note that cash benefits are only available for living persons.

What is the LifeLabs Class Action? 

A proposed Class Action was commenced arising out of a data breach announced by LifeLabs Inc. on December 17, 2019 (“the Action”). The representative plaintiffs are: Alita Marie Carter, Anna Belle Tharani, and Albert Ototé.

The Action was brought against LifeLabs Inc. and related LifeLabs companies (“LifeLabs”) following the attack by a criminal cyber-attacker on its database of customer personal health information. The Action alleged that LifeLabs was negligent in its protection of that data. LifeLabs denied all such allegations.

The Ontario Superior Court of Justice declares that the following persons are Class Members:

All persons in Canada who are living as of the date of Settlement Approval who is a current or former user of LifeLabs services whose personal information is known to have been exfiltrated as part of the data breach publicly disclosed on December 17, 2019, excluding any officer, director, or executive level employee of the Defendants.

The Class includes approximately 8.6 million persons whose personal information (including provincial health card numbers) was stolen, including approximately 131,957 Class members whose confidential test requisitions or test results were stolen by hackers.

LifeLabs paid a ransom and the cyber-attackers returned the data. That data has not been identified as being sold on the dark web or otherwise misused by anyone.

The Ontario Superior Court of Justice has certified the Action and on October 25, 2023, approved the negotiated settlement.

The time has now passed to object to the settlement or class counsel fees. The time has also passed to opt-out of this class action.

As of December 2023, if you are a Class member, you may submit a claim for a portion of the Settlement Fund by clicking here. As per the negotiated settlement, you will need the following information to submit a claim: your name, address, telephone number, email and Provincial Health Care Number.

Who can receive payment under this Class Action?

LifeLabs has agreed to make a payment to Class Members who submit a valid claim form within the 120-day claim period, which is expected to start in December 2023.

LifeLabs will pay a guaranteed amount of $4.9M, and up to a further $4.9M depending on the number of claims made (the “Settlement Funds”). Each Class Member who completes a valid claim form during the claim period will be eligible to receive compensation of $50, up to a maximum of $150. Note that Class Members may receive more or less than $50, depending on the number of claims filed, and the legal fees and disbursements which have been approved by the Court.

In exchange for LifeLabs paying the Settlement Funds, LifeLabs will be released by the Class from all forms of potential claims against LifeLabs arising from the data breach.

The Plaintiffs retained Class Counsel on a contingency fee basis, which means that the lawyers do not get paid unless the Court approves a settlement of the Action or awards a monetary judgment after a trial. 

The Court approved Class Counsel legal fees totalling 25% of the Settlement Funds paid by LifeLabs, plus taxes and disbursements.

The claim form must be received electronically no later than April 6, 2024, 5:00 (Pacific Time), or if mailed must be postmarked no later than April 6, 2024. 

This website will be updated on a regular basis in order to provide the Class Members with the most recent information and status of the administration of the Settlement Agreement.

The Claim Administrator will accumulate and review all claims received during the claim period, which is from December 8, 2023, to April 6, 2024.  

Payments will only occur after the end of the claim period. Once you submit your claim form with all fields completed and signed, no further action is required until it is time for the payments to be made, which will be subsequent to April 6, 2024.  

You will have to provide your contact details, Provincial Health Card Number, and your preferred payment method.  

You will also need to certify that you spent time or money responding to the LifeLabs Data Breach.

Information provided will be used for the purpose of confirming that you are an eligible Class Member and for the processing of your claim, which includes sending you the payment.

If you are a member of the Class and do not submit a claim form, you will not receive any payment as part of the Settlement Agreement and will have released LifeLabs from all forms of potential claims arising from the data breach.

To receive a benefit, you must submit a duly completed and signed claim form during the claim period.
